You Scream, I Scream, We All Scream, For…..Listeriosis (Coverage)? Applicability of the Pollution Exclusion to Bacteria Related Claims

Charleston, SC – August 19, 2015 – Associate Tommy Boger published an article in the Defense Research Institute’s quarterly publication, Strictly Speaking, regarding recent bacteria related ice cream product recalls and the applicability of the pollution exclusion in Commercial General Liability policies.

The article addresses the differing positions taken by courts as to whether listeria, bacteria, or any other unspecified type of “contaminant” and “non-traditional environmental pollution” are precluded from coverage pursuant to the pollution exclusion.
